The battery for the D40 does not hold a charge very long. Is it better to buy on Ebay a NOS Nikon battery or a new 3rd party battery? I know I can get a new Nikon at B&H but don't want to spend $45.

I use 3rd party batteries for both my D50 and D300 and never had an issue.
Equipment: D810 | D300 | D50 | B700 | P5000 and some lenses.
Software: Adobe Photoshop Elements 15 + NIK Software Suite

Thanks Herman. I'll just get a cheapie aftermarket battery. I don't use the D40 much and really not too concerned about the battery damaging the camera.
